      要:
Statistical consulting and collaboration have long been recognized primarily for the contribution to the selection and application of statistical methods. While this holds for empirical legal studies as well — be it for using data to describe, explain, or predict the legal phenomenon — legal studies, at its core, is a discipline centered on legal rules and legal norms through a doctrinal approach. In this pursuit, the merit of legal data analysis largely lies in the legal feedback it provides to doctrinal and normative inquiries. In this talk, I will discuss how to embed statistical inference into such a framework to move beyond the role of a methodological import and serve instead as an insider within legal reasoning. To illustrate this point, I will first present the full statistical consulting cycles behind the two amicus briefs regarding criminal law submitted in 2023 and 2024, and then elaborate on how the status quo unveiled by these briefs brings about the subsequent normative research questions that are answered empirically. This reveals another facet of statistical consulting: the contribution of statistics to other fields is valued not for polished outputs like tables, figures, and significant regression coefficients, but for serving as a foundation to forge a rigorous pathway to “reasoning with numbers,” particularly as a starting point for dialogue with the doctrinal scholarship.
